Mobile Messaging Terms and Conditions

Last updated: May 28, 2023

These Mobile Messaging Terms and Conditions ("Mobile Messaging Terms") govern the mobile messaging program (the "Program") operated by Antonella's Pizzeria. By enrolling, signing up, or agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy, which is available at www.antonellaspizza.com/privacypolicy. The Program and the collection and use of your personal information are also subject to our [insert name of general terms of use agreement, if applicable], which can be found at [insert link if applicable].

  1. Program Description: The Program allows us to send various types of mobile messages to you. Promotional messages are intended to advertise and promote our products and services, which may include promotions, specials, other marketing offers, and reminders for abandoned checkouts. Transactional messages are related to existing or ongoing transactions and may include order notifications and updates, appointment reminders, and other transaction-related information. These mobile messages may be sent using automated technology, such as an autodialer, automated system, or automatic telephone dialing system. The frequency of messages may vary but will not exceed a certain number of messages within a specific timeframe. By participating in the Program, you agree to receive messages from us, our affiliates, and any third-party service providers on the aforementioned topics or any other topic. Please note that different telephone numbers or short codes may be used to send these messages. While we do not charge for mobile messages sent through the Program, you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for SMS and MMS alerts.

  2. User Opt-In: By providing your mobile phone number to us, you are voluntarily opting into the Program and consenting to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if that number is registered on any state or federal "Do Not Call" list. You confirm that the mobile phone number you provide is valid and that you are the owner or authorized user of that number. If you change your mobile phone number or are no longer the owner or authorized user of the provided number, you agree to promptly notify us at [insert email or other contact method]. Please note that participation in the Program is completely voluntary, and it is not required to make any purchase from us.

  3. User Opt-Out and Support: You have the right to opt-out of the Program at any time. If you wish to stop receiving mobile messages from us or no longer agree to these Mobile Messaging Terms, simply reply with any of the following keywords to any mobile message from us: STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE. After opting out, you may receive text messages for a short period while we process your request, and you might also receive a one-time opt-out confirmation message. You understand that this is the only reasonable method of opting out. For support, reply with the keyword HELP to any mobile message from us. Please note that our mobile messaging platform may not recognize requests that modify the provided opt-out commands, and we, along with our service providers, will not be held liable for failing to honor requests that do not comply with the requirements outlined in these Mobile Messaging Terms. Furthermore, we reserve the right to change the telephone number or short code used to operate the Program, and we will notify you of any such change. Please be aware that any requests sent to a telephone number or short code that has been changed may not be received by us, and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.

  4. Disclaimer of Warranty and Liability: The Program is offered on an "as-is" basis and may not be available in all areas, at all times, or on all mobile providers. Neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of mobile messages or information sent through the Program.

  5. Modifications: We reserve the right to modify or cancel the Program or any of its features at any time, with or without notice. In addition, we may modify these Mobile Messaging Terms at any time, to the extent permitted by applicable law. Any modifications to these terms will be effective when posted on our website. We recommend that you periodically review these Mobile Messaging Terms to stay informed of any changes. Your continued participation in the Program after modifications have been made will constitute your acceptance of those changes.

Please note that these Mobile Messaging Terms are written in English.
